1. Acceptance of Terms
By downloading, installing, or using Condo Super ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Condo Super is an employee management application designed for property management organizations. The App provides time tracking, task management, photo/video documentation, secure messaging, and team coordination features.
3. User Accounts
To use Condo Super, you must:
- Be at least 16 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Be responsible for all activities under your account
- Notify us immediately of any unauthorized account use
4. Organizational Accounts
If you create an organization account as an Admin, you represent that you have authority to bind that organization to these Terms. Organization Admins are responsible for managing user access and ensuring their team members comply with these Terms.
5. Acceptable Use
You agree NOT to:
- Use the App for any unlawful purpose
- Share your login credentials with others
- Attempt to gain unauthorized access to any part of the App
- Upload malicious code, viruses, or harmful content
- Interfere with or disrupt the App's functionality
- Use the App to harass, abuse, or harm others
- Falsify time entries or location data
- Use the App in violation of any applicable laws or regulations
6. Time Tracking and Location Data
The App collects GPS location data when employees clock in and out. By using these features, you consent to this collection. Employees must ensure their time entries are accurate and honest. Falsification of time records may result in account termination and may violate employment laws.
7. Content and Data
You retain ownership of content you upload (photos, videos, documents). By uploading content, you grant us a limited license to store, display, and transmit that content as necessary to provide the service. You are responsible for ensuring you have rights to upload any content.
8. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Intellectual Property
Condo Super and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.
10. Third-Party Services
The App integrates with third-party services (Firebase, Apple Push Notifications). Your use of these services is subject to their respective terms and policies.
11. Service Availability
We strive to maintain reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features with reasonable notice. We are not liable for any service interruptions or data loss.
12. Termination
You may stop using the App at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. Organization Admins can delete organizational accounts through the App settings.
13. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP.
15. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via the App or email. Continued use after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the jurisdiction where our company is registered, without regard to conflict of law principles.
18. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law. You agree to resolve disputes individually and waive any right to participate in class actions.
